Terms of Service
A creative studio for product imagery. These terms explain the service, your responsibilities and how generation credits work.
1. Operator and scope
BestImage.com is operated by Andrejus Sevcovas, individual-activity certificate number 480837, Algirdo 22–21, 03218 Vilnius, Lithuania. Contact us through the Contact page or this postal address. These terms apply to the current AI Brand Photography Studio, not the retired manual batch-preparation service.
Read these terms before using the studio. Where checkout becomes available, the offer and applicable terms will be presented before purchase. Nothing here overrides mandatory consumer or data-protection rights. The Privacy Notice explains personal-data handling; it is not a request to waive those rights.
2. What the studio provides
The studio lets you upload a product photograph, choose a scene direction, composition and lighting, add creative notes and request an AI-generated product image. Projects, brand preferences and results can be saved and reviewed where the relevant feature is available. AI processing is performed through external infrastructure and OpenAI.
The service is currently in private validation. Public credit sales are disabled, and generation access may be restricted to authorised test accounts. A visible preview or a saved draft does not mean generation is available. Paid subscriptions, unlimited generation, guaranteed five-second results and human retouching are not included unless expressly stated in a specific future offer. The curated scene library provides starting directions; its available looks may expand over time. Each new image generation uses the credit allowance shown in the studio before submission.
3. Accounts and eligibility
You must be at least 18 and able to enter a binding agreement. If acting for a business, you must be authorised to do so. Provide accurate account and billing information, protect your credentials and contact us promptly about suspected unauthorised use. Do not share account access in a way that exposes another person’s private projects or bypasses service limits.
4. Upload rights and processing permission
You retain your existing rights in uploaded material. Upload only material you own or are authorised to use, including any permissions needed for visible trademarks, designs or people. You grant BestImage a non-exclusive permission to store, reproduce, transmit and transform that material solely as needed to provide, secure and support the requested service, including processing by its infrastructure and AI providers.
We do not take ownership of your uploads or acquire a general right to use them in advertising. Featuring your private work in public marketing would require separate permission. The generation checkbox authorises the source-image transfer described in the Privacy Notice. Do not upload passwords, API keys, payment details or unrelated sensitive personal information.
5. Outputs and commercial review
To the extent BestImage holds transferable rights in an output created for you, we assign those rights to you, subject to your rights in the input and applicable third-party restrictions. This does not guarantee copyright protection, exclusivity or freedom from third-party claims. Other users or services may produce similar results.
AI may alter labels, logos, colours, proportions, textures or product features. You must inspect a result before publishing it and ensure its use complies with advertising, intellectual-property and marketplace rules. Do not use an image to make a false claim about the actual product. BestImage does not guarantee increased sales, marketplace approval or exact preservation of every product detail.
6. Acceptable use
- Do not submit unlawful content, infringement, impersonation, deceptive advertising or material that violates the applicable AI provider’s usage restrictions.
- Do not bypass access controls, obtain another user’s files, interfere with the worker or abuse accounts, credit grants or refunds.
- Do not submit malicious files or automate requests to evade throttling or intended service limits.
We may reject a request or restrict access where reasonably necessary for security, lawful operation or investigation. Where appropriate, we will explain the restriction and provide a way to contact support.
7. Generation credits and charges
When offered, a credit pack’s price, currency, included generations, any expiry and applicable tax treatment will be shown before payment. A pack does not create a recurring subscription unless the offer explicitly says so. No price from the retired preparation service applies automatically to AI generation.
The current studio reserves one credit for a single-image request or three credits for a three-image campaign bundle when the valid request is accepted. Each successful output consumes its reserved credit. A confirmed failed or expired output returns its reserved credit through the ledger; completed outputs in the same campaign remain charged. Repeated polling or reopening the same job does not itself consume another credit. A new generation request does. A completed result that does not match your creative preference is not automatically a technical failure; contact support if it is unusable or materially defective.
When purchases become available, accounting invoices will initially be reviewed and issued manually. Provide accurate billing details for your purchase. Contact us with your order number for invoice corrections. A payment confirmation and an accounting invoice are separate documents; approving an invoice does not itself allocate additional generation credits. Final applicable tax treatment will be disclosed before checkout opens.
Credits are service entitlements, not money, investments or transferable stored-value accounts. Payment refunds and ledger corrections may require review; a disputed or partially refunded balance may temporarily be locked to prevent inconsistent spending. This does not remove lawful refund rights.
8. Withdrawal, refunds and complaints
If you purchase as an EU consumer through a distance contract, you generally have 14 days to notify us that you wish to withdraw, subject to the rules applicable to the particular digital service or content. Contact us with your name, account email, order identifier, purchase date and a clear statement that you wish to withdraw. No special wording is required.
Starting an AI request or ticking an image-transfer box does not by itself waive withdrawal rights. Any request for immediate performance and acknowledgement required for a lawful withdrawal exception must be obtained separately where applicable. We do not currently rely on an automatic waiver. Refunds due under consumer law will be handled within the applicable statutory period and normally through the original payment method, unless another lawful arrangement is agreed.
Mandatory remedies for a digital service that is not supplied or does not conform remain available. Report problems through Contact so we can investigate and offer the remedy required in your circumstances. Business purchases do not automatically carry consumer cooling-off rights, but this does not excuse breach of our contractual commitments. You may seek help from the relevant consumer authority, including Lithuania’s State Consumer Rights Protection Authority.
9. Availability and files
Processing time varies with queue length, provider availability, image characteristics and safety checks. We cannot promise uninterrupted access or a fixed generation time. If your connection drops, reopen the saved project to check the existing job before submitting another request.
Download images you want to retain. The workspace is not a permanent backup service. During private testing, automatic file expiry is disabled; project deletion and requested erasure are handled as described in the Privacy Notice. Future storage limits or expiry rules will be disclosed before they apply, with appropriate notice for affected existing users. Do not rely on the retired service’s 30-day delivery rule.
10. Suspension, closure and responsibility
You may stop using the service and request account closure or erasure through Contact. Active jobs and legally required financial records may need to be resolved or retained. We may suspend access for material breaches, security risks or legal requirements, and will give notice and an opportunity to resolve the matter where appropriate. If a paid service is discontinued, we will address unused paid entitlements and mandatory remedies rather than treating them as automatically forfeited.
Each party is responsible for its obligations under applicable law. AI limitations do not exclude our legal responsibilities. Nothing in these terms excludes liability that cannot lawfully be excluded, including mandatory consumer remedies or responsibility for intentional wrongdoing.
11. Changes and governing law
We may update these terms for service, legal or security changes. Material changes will be notified where required; new terms do not retrospectively remove accrued rights or rewrite an existing paid purchase without a lawful basis. Lithuanian law applies, while consumers retain mandatory protections and jurisdiction rights available under applicable law in their country of residence. No exclusive Lithuanian court requirement is imposed on consumers.
12. Contact and dispute resolution
Use our Contact page for service questions, complaints, refund requests or rights enquiries. Include a project or order identifier where relevant, but never credentials. We will investigate the issue and explain the proposed resolution. You remain free to use competent authorities, applicable dispute-resolution procedures or courts.
